Welcome to PosteAhora ("Service," "Platform," "we," "our," or "us"). PosteAhora is operated by Aleksandr Borisov (CUIT: 27-96484697-4), Monotributo - Régimen Simplificado para Pequeños Contribuyentes, Categoría A. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and PosteAhora governing your access to and use of our social media management platform, including our website, mobile applications, and related services.

By accessing or using PosteAhora, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Service. These Terms apply to all users, including visitors, registered users, and subscribers.

PosteAhora is a social media management platform that enables users to:

• Connect and manage multiple social media accounts (Facebook, Instagram, TikTok, YouTube, X/Twitter, LinkedIn, Threads)
• Create, schedule, and publish content across multiple platforms
• View analytics and performance metrics for published content
• Manage a content calendar and library
• Access platform-specific features and optimizations

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3.1 Account Creation

To use PosteAhora, you must:

• Be at least 13 years old (or 16 in the EU) and have the legal capacity to enter into contracts
• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms, illegal activity, or for any reason we deem necessary to protect the Service, other users, or third parties.

You agree not to use PosteAhora to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property, privacy, or other rights of any third party
• Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Post spam, unsolicited promotional content, or content that violates platform policies
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks
• Use automated systems (bots, scrapers) to access the Service without our written permission
• Reverse engineer, decompile, or disassemble any portion of the Service
• Collect or harvest information about other users without their consent
• Use the Service to violate any platform's terms of service (Facebook, Instagram, TikTok, YouTube, X/Twitter, LinkedIn, Threads)

Violation of this Acceptable Use Policy may result in immediate termination of your account and may subject you to legal liability.

PosteAhora integrates with third-party social media platforms via their APIs. By connecting your accounts, you acknowledge and agree to the following:

• You are responsible for complying with each platform's terms of service and policies
• You grant PosteAhora permission to access and manage your accounts as authorized by you
• You can revoke access at any time through your account settings or the platform's settings
• We are not responsible for actions taken by third-party platforms, including content removal, account suspension, or API changes

6.1 Your Content

You retain all ownership rights to content you create, upload, or post through PosteAhora. By using our Service, you grant PosteAhora a limited, non-exclusive, royalty-free, worldwide license to:

• Store, process, and transmit your content to provide the Service
• Post your content to the social media platforms you designate
• Display and perform your content within the Service for your use

6.2 Our Content

All content, features, and functionality of PosteAhora, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are the exclusive property of PosteAhora or its licensors and are protected by copyright, trademark, and other intellectual property laws.

7.1 Payment Processing

PosteAhora uses Polar.sh as our Merchant of Record for payment processing. By making a purchase, you agree to Polar.sh's Terms of Service: polar.sh/legal/terms

• All payments are processed securely through Polar.sh
• Payment information is handled by Polar.sh and subject to their privacy policy
• We do not store or process credit card information directly

7.2 Subscription Terms

If you subscribe to a paid plan:

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Your subscription will automatically renew unless you cancel before the renewal date
• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We reserve the right to change subscription fees with 30 days' notice

7.3 Refunds

Refund requests are administered together with Polar.sh and must be submitted within 30 days of the charge date. Refunds may be issued for duplicate charges, unauthorized transactions, or technical issues that prevent service access. Partial billing periods and use of the Service after the free trial are generally not refundable. The Service and its original content, features, and functionality are and will remain the exclusive property of PosteAhora and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written permission.

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of the software, unless laws prohibit these restrictions or you have our written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free
• We do not guarantee that results obtained from use of the Service will be accurate or reliable
• We are not responsible for actions taken by third-party platforms that affect your content or accounts
• We do not warrant that defects will be corrected or that the Service is free of viruses or other harmful components

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POSTEAHORA, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from actions taken by third-party platforms
• Damages resulting from service interruptions or technical failures

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless PosteAhora, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including copyright, trademark, privacy, or other proprietary rights
• Content you post or transmit through the Service
• Your violation of any platform's terms of service

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

You may terminate your account at any time by deleting your account through your account settings or contacting us. Upon termination:

• Your right to use the Service will immediately cease
• All content and data associated with your account may be deleted (subject to our data retention policy)
• Any outstanding fees remain due and payable
• Sections of these Terms that by their nature should survive termination will survive

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be addressed through good faith negotiation. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive any right to a jury trial or to participate in a class action, except where such waiver is prohibited by law.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. We may also notify you via email or in-app notification for significant changes. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PosteAhora regarding the use of the Service and supersede all prior agreements and understandings.
